Terms of Service

1. Scope
These Terms of Service govern all agreements between Quiltek ("Service Provider") and the client ("Client") for design services including 3D modelling, CAD design, product development, and creation of print-ready STL files.
2. Formation of Contract
The content of quiltek.io constitutes an invitation to submit an enquiry, not a binding offer. A contract is formed only upon written order confirmation by the Service Provider or commencement of work.
Quotes are non-binding unless explicitly stated otherwise.
3. Scope of Services
The precise scope of services is defined in the proposal or order confirmation. Changes to agreed scope require written agreement and may result in adjusted fees.
4. Fees and Payment
Fees are as agreed in the proposal. All prices are exclusive of applicable taxes unless stated otherwise.
Invoices are payable within 14 days of the invoice date without deduction.
For projects valued over €500, the Service Provider may require a deposit of up to 50% before commencing work.
5. Client Obligations
The Client shall provide all information, materials, and access required for the provision of services in a timely and complete manner. Delays arising from insufficient Client cooperation entitle the Service Provider to extend agreed deadlines accordingly.
6. Intellectual Property
All works created (3D files, CAD models, renderings, etc.) remain the property of the Service Provider until full payment is received.
Upon full payment, the Service Provider grants the Client a non-exclusive, non-transferable licence to use the works for the contractually agreed purpose.
STL files purchased from the shop are subject to the licence specified in the shop. Redistribution, resale, or commercial use beyond the licence scope is prohibited.
7. Limitation of Liability
The Service Provider is liable without limitation for damages arising from injury to life, body or health, and for intentional or grossly negligent acts.
Liability for minor negligence is limited to the foreseeable damage typical for this type of contract, up to the value of the relevant order.
8. Warranty
The Service Provider warrants that files will conform to agreed specifications. Defects must be reported in writing within 14 days of delivery. The Service Provider has the right to remedy defects.
9. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
